Plain language. No fine print manoeuvres. If something here surprises you, that's on us — and we'd want to know about it.

PREAMBLE // Before We Start

These Terms of Service govern your use of the Convict Shirts website at convictshirts.com and your purchase of products from us. By accessing the site or placing an order, you agree to these terms.

We have written them in plain language because we think that is the correct way to write legal documents that people are actually expected to read and understand. If something is unclear, contact us and we will explain it. The goal is not to create a document that protects us from you — it is to set out clearly what you can expect from us and what we ask of you.

⚖ Australian Consumer Law — Your Rights Are Preserved

Nothing in these Terms of Service limits, excludes or modifies any right or remedy you have under the Australian Consumer Law, the Competition and Consumer Act 2010 (Cth), or equivalent consumer protection legislation in your jurisdiction. Any term that purports to exclude or limit a statutory consumer guarantee is void to the extent of the inconsistency.

Your statutory rights exist independently of these terms and are not affected by them. These terms operate alongside your legal rights, not instead of them.

Who Is Who

We / Us / Our Convict Shirts, operating at convictshirts.com. The entity responsible for this website and the products sold through it. You / Your The person accessing the website or placing an order. If you are placing an order on behalf of a business or organisation, you represent that you have authority to bind that entity to these terms. Site The website at convictshirts.com, including all pages, content, and features accessible through it. Products The graphic tees and any other physical goods offered for sale through the site. Order A purchase of one or more Products made through the site, confirmed by an order confirmation email from us. Drop A monthly limited-run collection released on the first Friday of each month. Each Drop is a distinct collection with a fixed run size. ACL The Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth), as amended from time to time. Consumer Guarantee A guarantee provided under the ACL or equivalent legislation, including guarantees that goods are of acceptable quality, match their description, and are fit for purpose. Placing An Order

How An Order Is Formed

Your order is an offer to purchase. We accept that offer when we send you an order confirmation email. Until you receive that confirmation, no contract has been formed and no obligation to supply exists. We reserve the right to decline an order after it has been placed — for example if a product sells out between your checkout and payment processing, or if we identify an error in the product listing. In such cases a full refund will be issued promptly.

Pricing

All prices displayed on the site are in Australian Dollars (AUD) unless otherwise stated. Prices include Australian GST where applicable. International customers may see prices converted to their local currency as an estimate — the charge processed will be in AUD at the exchange rate applied by your bank or payment provider at the time of transaction.

We take reasonable care to ensure prices are accurate. If a pricing error is identified after your order is placed, we will contact you before processing. You will have the option to proceed at the correct price or cancel for a full refund. We will not fulfil orders at a clearly incorrect price.

Payment

Payment is processed at the time of order through our third-party payment providers. We accept the payment methods displayed at checkout. We do not store your full card details — payment data is handled by our payment processors in accordance with PCI DSS standards. We are not responsible for errors or failures attributable to your bank or payment provider.

Order Confirmation

You will receive an order confirmation email at the address provided at checkout. Check your spam folder if it doesn't arrive within a few minutes. The confirmation email is your receipt — keep it. If you do not receive a confirmation within 24 hours, contact us before assuming the order was placed successfully.

Cancellations

Given the limited-run nature of our products, we ask that you review your order carefully before placing it. We will accommodate cancellation requests made within 2 hours of placing an order, provided the order has not yet entered fulfilment. Contact us immediately at hello@convictshirts.com with your order number. After 2 hours or once fulfilment has begun, cancellations are handled under the returns policy.

We process orders promptly because our customers want their drop quickly. The 2-hour cancellation window reflects this. If you've made a genuine error — wrong address, wrong item — contact us as fast as possible and we'll do everything we can to intercept it.

What You're Buying

Product Descriptions

We take care to describe our products accurately. Product images are representative — colours may appear slightly differently on screen due to monitor calibration. If colour accuracy is important to your purchase decision, contact us before ordering and we will describe the actual printed colour as precisely as we can.

Limited Runs

All Convict Shirts products are produced in limited runs with a fixed quantity set before each Drop. We do not restock sold-out designs. This is a structural feature of the brand, not a temporary condition. The availability shown on the site reflects current stock. Adding an item to your cart does not reserve it — stock is only confirmed at successful payment processing.

Sizing

Size guides are provided on each product page and reflect the actual measurements of the garment. We recommend measuring a tee you own and comparing rather than relying solely on your usual size. If a size is unavailable in a design you want, it will not be restocked. If you are unsure, contact us before ordering — we are happy to advise.

Care Instructions

Care labels are included in all garments. Following care instructions is important both for the longevity of the tee and for the validity of any fault claim related to print quality. Damage caused by not following care instructions is not covered under our returns policy or ACL consumer guarantees.

Content & Design

Our designs contain satire, dark comedy, political commentary and other content intended for a mature audience that appreciates the tradition of dissident expression. By purchasing, you confirm you are 18 years of age or older, or that a parent or guardian has reviewed and approved the purchase. We do not produce content that targets individuals based on protected characteristics — see our About page for the full statement of what we will and won't make.

Getting It To You

Dispatch Timeframes

Orders are dispatched within 3–5 business days of order confirmation. During Drop launch periods, dispatch may take up to 5 business days due to order volume. We will notify you by email if your order is delayed beyond this window.

Delivery Estimates

Delivery timeframes after dispatch are estimates provided by the carrier and are not guaranteed by us. Typical timeframes: Australia 2–7 business days; New Zealand 5–10 business days; United Kingdom and Europe 10–20 business days; United States and Canada 10–20 business days; rest of world 15–25 business days. These estimates reflect normal carrier performance and may be affected by public holidays, customs delays and circumstances beyond our control.

Tracking

All orders are dispatched with tracking. You will receive a tracking number by email when your order is dispatched. Tracking updates are provided by the carrier and we are not responsible for the accuracy or timeliness of tracking information displayed by third-party carrier systems.

Delivery Address

You are responsible for providing an accurate and complete delivery address. We are not responsible for non-delivery caused by an incorrect address provided at checkout. If an order is returned to us due to an incorrect address, we will contact you and offer redelivery at your cost or a refund of the product value less original postage costs.

International Customs & Duties

International orders may be subject to customs duties, import taxes or other charges levied by the destination country. These charges are outside our control and are the responsibility of the recipient. We are legally required to declare the accurate value of goods on customs documentation — we will not falsify customs declarations under any circumstances, regardless of request.

Lost or Damaged in Transit

If your order does not arrive within a reasonable period beyond the estimated delivery timeframe, or arrives damaged, contact us at hello@convictshirts.com. We will investigate with the carrier. Items confirmed lost or damaged in transit will be replaced or refunded in full. We will not ask you to pursue the carrier directly — that is our responsibility to manage.

RETURNS

Not Right? Let's Fix It.

Our full Returns and Refunds Policy is published separately at convictshirts.com/pages/returns and is incorporated into these Terms of Service by reference. In the event of any inconsistency between these Terms and the Returns Policy on a matter relating to returns, refunds or consumer guarantees, the Returns Policy prevails.

The key points: 30-day change of mind window for unworn items in original condition; full remedy for faulty or misdescribed goods under ACL with no fixed time limit; full cash refund where a faulty item from a sold-out run cannot be replaced like for like; store credit valid for 24 months. Your statutory rights are not limited by anything in this document.

What's Ours

Our Content

All designs, copy, images, graphics, editorial content, brand assets and other materials on the Convict Shirts site are the intellectual property of Convict Shirts or are used under licence. This includes but is not limited to all tee designs, the Convict Shirts name, logo and visual identity, and all written content on the site.

What You Can't Do

You may not reproduce, copy, distribute, sell or commercially exploit any Convict Shirts content or designs without our express written permission. You may not use our designs to create derivative works, counterfeit products, or any item that could be mistaken for a genuine Convict Shirts product. You may not use the Convict Shirts name, logo or brand identity in any way that implies endorsement, affiliation or partnership without our written consent.

What You Can Do

You may share images of products you have purchased for personal, non-commercial purposes, including on social media, provided the attribution to Convict Shirts is clear. You may quote brief extracts of our editorial content for the purpose of review, commentary or criticism, provided the source is attributed and a link to the original is included.

Satire & Fair Dealing

Our designs are produced under the fair dealing provisions of Australian copyright law and equivalent provisions in other jurisdictions, including the doctrines of fair use (US) and fair dealing for criticism, review and parody (UK, Australia). We believe strongly in the right to satirise public figures, institutions and official language. We ask that others extend the same principles to any commentary on our work.

If you believe any content on the site infringes your intellectual property rights, contact us at legal@convictshirts.com with specific details. We take IP claims seriously and will investigate promptly. We also take the distinction between genuine IP infringement and attempts to suppress legitimate satire seriously — and will respond to each accordingly.

ACCEPTABLE USE

How To Use The Site

By accessing the site you agree to use it only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the site.

7.1 No automated scraping or crawling You may not use bots, scrapers or automated tools to extract data from the site without our express permission. This includes pricing data, product descriptions and design content. 7.2 No fraudulent orders or chargebacks You may not place orders with fraudulent intent, use stolen payment details, or initiate chargebacks for goods that were legitimately supplied and match their description. Fraudulent chargebacks will be disputed with supporting evidence. 7.3 No resale misrepresentation You may resell products you have purchased for personal reasons, but you may not misrepresent the provenance, condition or authenticity of products when reselling them. 7.4 No interference with the site You may not attempt to gain unauthorised access to any part of the site or its underlying infrastructure, introduce malicious code, or interfere with the normal operation of the site or its users. 7.5 Bulk purchasing for commercial resale If you wish to purchase multiple units for commercial resale purposes, contact us first. We reserve the right to limit order quantities per customer per Drop and to cancel orders we reasonably believe are intended for commercial resale at scale without prior agreement. LIABILITY

What We're Responsible For

What We Are Responsible For

We are responsible for supplying products that match their description, are of acceptable quality, and are fit for purpose — as required by Australian Consumer Law. We are responsible for addressing faults, errors and non-delivery in accordance with our Returns Policy and your statutory rights. We are responsible for the accuracy of the information we publish about our products, our policies and our practices.

Limitations On Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the site or purchase of products is limited to the price you paid for the relevant product. We are not liable for indirect, consequential, incidental or special damages arising from your use of the site or products, including loss of profit, loss of data, or reputational damage, except where such liability cannot be excluded under applicable law.

ACL Overrides Any Limitation

Nothing in this section limits any right or remedy you have under Australian Consumer Law or equivalent legislation. Where a statutory guarantee applies and cannot be excluded, our liability is limited — to the extent permitted by law — to: repair or replacement of the goods; resupply of equivalent goods; or payment of the cost of repair, replacement or resupply. For goods purchased primarily for personal or domestic use, even these limitations may not apply.

Third-Party Services

The site may contain links to third-party websites or use third-party services including payment processors and delivery carriers. We are not responsible for the content, privacy practices or performance of third-party services. Your use of those services is governed by their own terms and policies.

Website Availability

We take reasonable care to keep the site available and functional but do not guarantee uninterrupted access. The site may be unavailable during maintenance, updates or circumstances beyond our control. We are not liable for losses arising from website unavailability, including inability to purchase during a Drop.

In practice, if something goes wrong with your order, we fix it. The legal limitation language above is standard and required — it exists because no business can accept unlimited liability for every conceivable downstream consequence of a commercial transaction. It does not change our intention to deal with problems fairly and promptly.

PRIVACY

Your Data

Your privacy is governed by our Privacy Policy, published at convictshirts.com/pages/privacy and incorporated into these Terms by reference. The Privacy Policy explains what personal information we collect, how we use it, who we share it with, and how you can access, correct or delete it.

The short version, for clarity: we collect the personal information necessary to process your order and deliver your products. We use your email address to send order communications and, if you subscribe, the monthly drop list email. We do not sell your personal information to third parties. We do not use your data for advertising targeting without your consent. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and with the equivalent obligations under GDPR for customers in the European Union and UK.

The Drop List

Subscribing to the drop list is separate from placing an order. Subscribing means you consent to receiving one email per month containing the new collection preview. You can unsubscribe at any time using the link in every email. Unsubscribing from the drop list does not affect transactional emails related to orders you have placed.

Cookies

The site uses cookies for essential functions including maintaining your shopping session and processing payment. It may also use analytics cookies to understand how the site is used. You can manage cookie preferences in your browser settings. Disabling essential cookies may affect your ability to complete a purchase.

USER CONTENT

Reviews & Submissions

If you submit a review, comment, photograph or other content to the site or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our products and marketing, with attribution where practicable. You confirm that you own or have the right to submit the content and that it does not infringe any third party's rights.

We reserve the right to remove user content that is defamatory, abusive, illegal, or that misrepresents our products. We do not remove negative reviews on the basis that they are negative — only on the basis that they are false, abusive or otherwise in breach of these terms. If you believe a review about your experience has been removed unfairly, contact us.

We actively want honest reviews, including critical ones. A brand that makes satirical tees calling out managed narratives and then removes unflattering reviews would be operating with a fairly spectacular lack of self-awareness. We note this without particular pride — we just want the standard to be clear.

CHANGES TO TERMS
// 11 — Changes To These Terms

When Things Change

We may update these Terms of Service from time to time to reflect changes in our practices, applicable law, or the way we operate the site. When we make material changes, we will update the version date at the bottom of this page and, where the changes are significant, notify customers via the drop list email.

The terms that apply to your order are the terms in effect at the time your order is placed. Changes to these terms after your order is placed do not retroactively affect that order. Your continued use of the site after a change is published constitutes acceptance of the updated terms.

We will not make changes to these terms that reduce your statutory rights under Australian Consumer Law or equivalent legislation. Any such purported change would be void in any case — but we want to be explicit that this is not something we would attempt.

GOVERNING LAW

If Something Goes Wrong

Governing Law

These Terms of Service are governed by the laws of Australia. For customers in Australia, disputes are subject to the jurisdiction of the courts of the state or territory in which you reside, or the Federal Court of Australia. For international customers, Australian law applies to the contract between us, without prejudice to any mandatory consumer protection rights you have under the laws of your own jurisdiction.

Dispute Resolution — Start Here

If you have a complaint or dispute, please contact us first. The overwhelming majority of issues can be resolved quickly and directly. We commit to responding to complaints within 2 business days and to working toward a resolution within 10 business days of the complaint being raised.

External Dispute Resolution

If we are unable to resolve your complaint directly, you have the right to escalate to external bodies including the Australian Competition and Consumer Commission (ACCC), your state or territory consumer affairs office, or the relevant ombudsman. International customers may have access to equivalent dispute resolution bodies in their jurisdiction. We will cooperate fully with any such process.

Small Claims & Tribunals

Nothing in these terms prevents you from making a claim through a small claims court, consumer tribunal or equivalent body in your jurisdiction. For Australian customers, state and territory Civil and Administrative Tribunals (VCAT, NCAT, QCAT etc.) provide accessible, low-cost resolution of consumer disputes. We will attend and engage with such processes in good faith.
