Legal notice
LEGAL
NOTICE
Who we are, what we own, what we disclaim, what law governs this, and what your options are if you have a dispute with us. In plain language, without the boilerplate obscuring the substance.
Business Identity
Convict Shirts is an Australian business operating at convictshirts.com. The website, the brand, the graphic tee collections, the editorial content and all associated intellectual property are owned and operated by Convict Shirts.
For legal correspondence and formal notices: legal@convictshirts.com. For everything else, including orders, shipping queries and general correspondence: hello@convictshirts.com. The two addresses go to different places and using the right one will get your communication to the right person.
Intellectual Property
The Convict Shirts name, logo, brand identity, graphic designs, editorial content, Australian Slang Series, and all other original creative work produced by or for Convict Shirts is protected by Australian and international intellectual property law, including copyright and trade mark law.
You may not reproduce, distribute, modify, adapt, publicly display, or create derivative works from any Convict Shirts material without prior written permission. This includes, but is not limited to, the graphic designs on the tees, the editorial content on the website, and the brand identity elements.
Purchasing a Convict Shirts tee gives you the right to wear it. It does not give you a licence to reproduce the design on it. The design on your tee remains the intellectual property of Convict Shirts. The tee is a product. The design is a creative work. These are different things with different legal statuses.
User-Generated Content
If you post photographs or other content featuring Convict Shirts products on social media or elsewhere and tag or mention the brand, you grant Convict Shirts a non-exclusive, royalty-free, worldwide licence to use, reproduce and share that content for promotional purposes, with attribution. If you would prefer your content not be used in this way, say so — we will respect that immediately and without argument. We have no interest in using content created by people who do not want us using it.
Website Disclaimer
The convictshirts.com website and its content are provided in good faith for general informational and commercial purposes. To the maximum extent permitted by applicable law, Convict Shirts makes no representations or warranties of any kind, express or implied, regarding the completeness, accuracy, reliability, suitability or availability of the website or its content.
The editorial content on this website — including the Australian Slang Series, the pillar blog posts and all other written material — is produced with care and to a standard we are prepared to stand behind. It is not academic research and should not be cited as such. It contains opinions as well as facts. The opinions are labelled as opinions where they are opinions. The facts are checked. Neither are infallible.
Convict Shirts is not responsible for the content of external websites linked from this website. A link to an external site is not an endorsement of that site, its content, its owners or their views.
Limitation of Liability
To the maximum extent permitted by Australian Consumer Law and other applicable legislation, Convict Shirts' liability for any claim arising from your use of this website or purchase of our products is limited to the value of the order giving rise to the claim.
Nothing in this Legal Notice limits or excludes any right you have under Australian Consumer Law or equivalent consumer protection legislation in your jurisdiction. Your statutory consumer rights apply regardless of what this notice says. If there is a conflict between this notice and your statutory rights, your statutory rights prevail.
Convict Shirts is not liable for any indirect, incidental, special or consequential loss arising from use of this website or our products, to the extent that such limitation is permitted by law. This includes, but is not limited to, loss of data, loss of income or commercial loss.
Satire, Opinion and Public Interest Content
A significant portion of Convict Shirts' editorial and design output is satire — commentary on public events, institutions and figures, produced in the satirical tradition that has been a recognised form of protected expression in democratic societies since long before the company was founded. Satire is not defamation. Opinion is not misrepresentation. Humour is not malice.
Content on this website that comments on public figures, institutions or events does so in the public interest, in the satirical mode, and within the protections afforded to such expression under Australian law and the law of other democratic jurisdictions. If you are a public figure, institution or their representative and you have a concern about specific content, contact us at legal@convictshirts.com before engaging legal process. Most concerns can be resolved directly and proportionately.
We will not remove accurate factual content, legitimate satire or honest opinion on demand. We will engage in good faith with genuine concerns about specific factual errors or content that falls outside the bounds of fair comment. We will not engage with demands that are, in substance, requests to suppress accurate or protected commentary.
Privacy
Our handling of personal information is governed by the Convict Shirts Privacy Policy, available at convictshirts.com/pages/privacy-policy. This Legal Notice does not supersede or modify the Privacy Policy. If there is a conflict between this notice and the Privacy Policy on a privacy matter, the Privacy Policy governs.
Convict Shirts is subject to the Australian Privacy Act 1988 and the Australian Privacy Principles. Where we collect, hold, use or disclose personal information about individuals in the European Union, the General Data Protection Regulation (GDPR) also applies.
Governing Law and Jurisdiction
This Legal Notice and all matters arising from your use of convictshirts.com are governed by the laws of New South Wales, Australia. Any dispute that cannot be resolved informally is subject to the non-exclusive jurisdiction of the courts of New South Wales.
This does not affect any mandatory consumer protection rights you have under the law of your own jurisdiction. If you are a consumer in Australia, the UK, the EU, New Zealand or another jurisdiction with mandatory consumer protection laws, those laws apply to your purchase regardless of this governing law clause. The governing law clause applies to matters not covered by mandatory consumer protection law.
Dispute Resolution
If you have a complaint about a product, an order or anything else involving Convict Shirts, please contact us first at hello@convictshirts.com with a description of the issue and your order number if relevant. We will acknowledge your complaint within 2 business days and work to resolve it within 10 business days.
We would rather resolve a genuine complaint directly than have it escalate unnecessarily. Most issues are resolvable quickly by two people talking to each other in plain terms about what happened and what a fair outcome looks like. We approach complaints in that spirit and expect the same in return.
If a complaint cannot be resolved directly, Australian consumers may refer their matter to the relevant state consumer protection agency or the Australian Competition and Consumer Commission (ACCC). Consumers in other jurisdictions have access to equivalent national and regional consumer dispute mechanisms.
Changes to This Notice
This Legal Notice may be updated from time to time. When it is updated, the revised version will be published at this URL with the date of revision noted below. Continued use of the website after a revision constitutes acceptance of the revised notice.
We will not make changes to this notice that reduce your rights without notice. Changes that add obligations on your part will be flagged clearly. We are not in the business of hiding things in policy updates.
